| 摘 要： | 近年来,未成年人校园暴力犯罪呈低龄化趋势。从刑法基础理论出发,总结当前未成年人校园暴力犯罪的特征,阐述规制未成年人校园暴力犯罪的理论基础,剖析未成年人校园暴力犯罪刑法规制的缺陷与不足,提出增加规制校园暴力犯罪的专门立法和司法解释;优化对未成年人校园暴力犯罪案件的司法适用等建议,预防和矫正未成年人校园暴力犯罪,充分发挥刑法“惩治犯罪”与“保障人权”的作用。

| Abstract: | In recent years,the juvenile violent crimes on campus tend to be younger.Starting from the basic theory of criminal law,this paper summarizes the characteristics of the current juvenile campus violent crime,expounds the theoretical basis of regulating juvenile campus violent crime,analyzes the defects and deficiencies of criminal law regulation of juvenile campus violent crime,and puts forward some suggestions,such as increasing the specialized legislation and judicial interpretation of regulating campus violent crime,optimizing the judicial application of juvenile campus violent crime cases,for preventing and correcting juvenile campus violence crimes,and giving full play to the criminal law's role in"punishing crimes"and"protecting human rights." |
