| 摘 要： | 立案监督对于刑事诉讼的顺利进行、保障公民的人权具有重要的意义。但我国现行的立案监督制度存在诸多缺陷，影响其功能的发挥。从立法和制度建构方面对立案监督制度予以完善，对发挥立案监督功能、达到立案监督目的起着关键的作用。
