| 摘 要： | 就总体而言,西方当代“人权”理论的最基本的形态,仍然是“天赋人权”理论的精化和系统化。胡克、马里旦、罗尔斯、亨廷顿等人权理论家以及历史学派、“第四代人权论”等,均走向对“天赋”模式的悖离。

| Abstract: | As far as population is concerned, the basic model of the very Western 'human rights' theory is still the extraction and systemization of the "natural rights". The Western human rights theorists and the historical school and "the theory of the fourth generation human rights " are all going to the contrary road to the "natural" model. |
