| 摘 要： | 网络环境下著作权合理使用是指在法律规定的条件下,不必征得著作权人的同意,又不必向其支付报酬,基于正当目的而使用他人著作权作品的合法行为。我国著作权采用列举方式明确规定合理使用的事项。网络环境下,这一判断标准已很难适用。因此,我国著作权法中合理使用的判断标准,可以在传统模式基础之上,借鉴美国判断合理使用的标准来判断使用者的行为是否属于合理使用,即使用目的与性质、被利用作品的性质、使用作品的数量与重要性、使用对作品潜在市场或价值的影响。

| Abstract: | Fair use in copyright under the network environment means a legal behavior that in the conditions defined by the law,works may be used without permission and without paying to the copyright owner based on appropriate purpose.Enumeration mode is adopted in the copyright to definitely define the fair use.The current judgment criterion of fair use is not applicable to the network environment.So the judgment criterion of fair use in copyright may be referred to the mode of judgment criterion in America,that is,the purpose and nature of use,nature of the used works,quality and importance of using works,and the influences on works',potential market or value. |
