| 摘 要： | 囿于主权国家各自为政的国际政治格局,国际环境法发挥作用的机制受到制约:其内容无法全面、真实体现维护人类共同环境利益的理念,其执行也因诸多原因遭遇障碍。"治理"及"全球环境治理"通过扩大参与主体、改变调整手段、增加规则范围等方式应对全球性环境问题,弥补了国际环境法及国际环境保护机制的不足。而国际环境法也应顺应现实需求,适时完善其制度。

| Abstract: | Due to the current international political pattern which shows lack of coordination among independent countries,functions of the international environmental law are restrained.The contents of the Global Environmental Law cannot fully and realistically reflect the concept of safeguarding the common environmental benefits of human beings and thus its implementation faces various obstacles.Through the ways such as expanding participation,changing adjust measures and enlarging regulation scope to solve the global environmental problems,＂governance＂ and＂global environmental governance＂ cover the shortages of traditional international environmental protection mechanism.The practice of global environmental governance poses advanced requests to the International Environmental Law.In addition,the International Environmental Law should be adapted to meet the trend. |
