| 摘 要： | 依据《合同法》规定,约定的违约金低于或者过分高于造成的实际损失,当事人可以请求人民法院或者仲裁机构予以增加或者适当减少。由于现行法律和司法解释对此均未做出明确的规定,法官只能运用自由裁量权做出判断,这在一定程度上影响了执法统一。有鉴于此,文章拟就此问题进行一些探讨。

| Abstract: | According to the provision of the "Contract Law",if promissory penal sum is lower or excessively higher than the actual loss,the privy could request people's court or arbitration organization to increase or properly decrease the promissory penal sum.Owing to the fact that no current laws or judicial interpretation have defined the provision,judiciaries could only use discretionary power to make judgment,which in a manner affects the standardization of executing the law.Because of this,this paper probes into these issues. |
