| 摘 要： | 自由裁量权反映了行政权在现代社会治理过程中不断扩张的趋势,建设法治国家,必须控制行政自由裁量权。控制自由裁量权的着重点是地方政府的自由裁量行为,必须细化、量化行政裁量标准,建立系统的行政裁量基准,压缩行政裁量权的空间。通过系统的裁量基准,规范实践中的行政裁量行为,以期行政行为的恰当与公正。

| Abstract: | Administrative discretion reflects the ever-expanding trend of administrative power in modern social regulation.To construct our country under the rule of law,controlling administrative discretion,especially that of local government,is something complicated yet necessary.Emphasis should be laid on the standardization of local governments＇ discretional acts and feasible approach,to which is to establish systematic administrative discretion standard.Its aim is to ensure administrative behavior to be proper,rational and fair. |
