| 摘 要： | 微博作为一种新兴的网络传播媒体和交流方式在促进信息传播和共享的同时，也引发了关于著作权法问题的讨论。微博应视为著作权保护范围中的作品，理应受著作权法的保护，因此转发、上传他人享有著作权的微博实际上已构成侵权，但依据现有的著作权法又很难界定。所以，急需对微博著作权法进行认定及立法规范。与此同时，还要开展实名登记，完善对网络运营商的监管，大力加强对微博著作权的保护。

| Abstract: | Wei Bo, as a new network medium and means of communication, while promoting the dissemination and sharing of informa- tion, triggers a discussion on the issue of copyright law. Wei Bo should be deemed to be works in the sense of copyright protection, and also should be protected by the copyright law. Thus forwarding and uploading other Wei Bo may cause infringement, which is hard to define according to the present copyright law. Definition and regulation of Wei Bo copyright is necessary. Meanwhile, we can implement real-name registration; improve supervision of network operators so as to strengthen the protection of Wei Bo copyright. |
