| 摘 要： | 公有所有权，是指一定区域范围内的人群基于共同利益而对特定财产所享有的所有权，具体包括国家所有权和集体所有权。公有所有权具有公益性、利益主体抽象性、权利行使间接性以及权利保护方面的易侵性等特征。我国的集体土地所有权在性质上属于公有所有权。公有所有权理论是一个分析我国集体土地所有权的崭新视角，它可以正确解释我国集体土地所有权的历史和现状并为其完善提供理论基础。

| Abstract: | The public ownership refers to the ownership by the people within a certain region based on shared interests to specific property, including state ownership and collective ownership. They all have the features of public interest, abstractive subject, indirect exercise and vulnerability to infringement. In the nature, the collective ownership of land in China is one of the public ownerships. The theory of public ownership is a brand -new perspective to analyze the collective land ownership in China, since it can interpret the history and the present situation of the collective ownership of land in China correctly and provide a theo- retical basis for its perfection. |
