| 摘 要： | 针对离婚会给当事人带来损害，我国《婚姻法》规定了三种离婚补偿方式：家务补偿、经济帮助和离婚损害赔偿。对这三种方式的必要性和合理性进行了分析，并从离婚过错方精神损害赔偿责任的构成和离婚过错方损害赔偿的范围两方面分析了离婚过错方精神损害赔偿民事责任的构建问题。
