| 摘 要： | 1787年美国宪法最终确立了权力分立制衡原则.崇尚自由和珍视权利的殖民地人民在孟德斯鸩分权学说的深刻影响下,认真总结此前立法特别是州宪的经验,最终促成了这一原则的确定.这一原则的确立确保了美国"宪法主治",也对中国当代法治建设具有重要的借鉴作用.

| Abstract: | The U.S. Constitution of 1787 established the principle of separation of powers with check and balance at last. Deeply influenced by Montesquieu theory of separation of powers, seriously summarizing the former experience of legislation, especially the state constitutions, the colonial people, who upheld liberty and cherished right, helped to bring about the establishment of the principle at last, which ensures constitutional supremacy and provides reference for contemporary construction of rule of law in china. |
