| 摘 要： | 离婚损害赔偿请求权是一种基于法律直接规定的请求权。在责任认定上必须把握离婚损害赔偿制度的构成要件。离婚损害赔偿制度在目前仍然存在不少缺陷，因此，在程序上，应明确离婚损害赔偿请求权是一项实体权利；对因婚外同居造成当事人损害的赔偿性质、标准、幅度、责任主体范围等尽快做出明确规定；从法律上对无过错方的举证责任适当放宽条件，或者在特定的情况下适用举证责任倒置；应当制定相应的法律措施预防逃避离婚损害赔偿责任的发生。
