| 摘 要： | 网络时代给著作权利益平衡制度带来了前所未有的挑战。从法理出发进行考量后可以看出,这样一种“三轨并行”的设计是著作权利益平衡制度应对挑战的可行进路:对原有制度进行结构性调整,以解决传统作品领域的问题;在构建“许可授权机制”的同时引入“补偿法则”进行相互性调整,以解决网络时代出现的新问题。与此同时,“知识鸿沟”的出现给著作权利益平衡制度提出如何在“知识共享”和“权利保护”之间寻求合理平衡点的问题也值得重视。

| Abstract: | Internet brings lots of challenges that we have never seen,especially in Intellectual Property area.What should we do when everything is changing? Based on Jurisprudence,there are three methods that we can use from the prospective of copyright.Firstly,we can adjust former systems in order to solve traditional issues.Secondly,some license systems(e.g.Creative Commons License) are useful to solve some problems.Besides,"compensatory principle" is also needed.In a word,we should pay more attention to the question about how to "share" and "protect" in domain of Intellectual Property interest balance. |
