| 摘 要： | 知识产权的保护与信息共享是一对矛盾。文章列举了数字图书馆建设和使用过程中诱发知识产权纠纷的领域和服务环节，简要剖析了存在侵权风险的原因，并对知识产权保护对数字图书馆发展的制约因素逐一论述，从立法和实践两个方面提出了构建知识产权保护与信息共享二者平衡和谐机制的建议。

| Abstract: | There is a contradiction between the intellectual property rights protection and information sharing . This paper enumerates the realms and the service links that there are disputes of the intellectual property fights in the digital library construction and the usage processes, analyzes the reason of the existing infringement risk, and discusses the restricted factors of the digital library development is conditioned by the intellectual property fights protection. Some suggestions to set up the mechanism of equilibrium and harmony of intellectual property fights protection and information shafing from two aspects of legislation and practice are put forward |
