| 摘 要： | 从现有的著作权法律体系看,权利穷竭仅适用于发行权,而不适用于信息网络传播权,但是公益性图书馆的数字馆藏在提供面向互联网的读者服务时,如不适用权利穷竭原则,将给图书馆传播信息和知识带来极大的障碍,因此,有必要考虑给予图书馆以例外的规定,图书馆工作者应努力推动这一例外纳入著作权法律规范中。正在征求意见的《信息网络传播权保护条例(草案)》对此作了相关的规范,为图书馆合理、合法地使用数字资源带来了契机。

| Abstract: | According to the current copyright law system, the exhaustion of right only applies to the issue right and doesnt apply to the right of communication through network. If the doctrine of exhaustion of the right wouldnl be performed, it might hinder greatly libraries to provide the digital resource to the readers by the Internet . Therefore, the exception regulation should be given to the libraries and the librarians must try hard to bring this exception into the copyright law norm. There are some relative rules on the Regulations on the Protection of the Right of Communication through Information Network (draft) which has been asking for advices , which also means the turning point is coming for the libraries to use the digital resource rationally and legally. |
