| 摘 要： | 分析了信息网络传播权的立法模式与信息网络传播权例外的类型,剖析图书馆的业务与网络传播的关系,将可适用于图书馆的信息网络传播权例外按照不同的标准分别划分为两大类型:从信息网络传播权立法模式来看,可以分为适用于图书馆的信息网络传播权例外,以及以承载了信息网络传播权保护功能的若干项著作权专有使用权例外所构成的、可适用于图书馆的信息网络传播权例外。从信息网络传播权例外的适用主体来看,可以分为适用主体为图书馆的信息网络传播权例外,以及适用主体为网络信息提供者的信息网络传播权例外。

| Abstract: | The paper analyzes the legislation mode of information network communication right and the variety of exception of information network communication right,explores the relationship between library practice and information network communication,and sums up the exception of information network communication right into two types: exception of information network communication right applicable to library world and several exceptions of exclusive right forming information network communication right from the perspective of legislation mode;exception main body that is library world and exception main body that is information network communicator from the aspect of exception main body. |
