| 摘 要： | 李明德等诉南通市图书馆确认著作权、返还财产纠纷一案,涉及到作品的作者如何认定、职务作品的著作权归属以及著作权转让后作品的著作权归属等问题.本案暴露了图书馆法律意识淡薄,接受捐赠工作不规范的事实,启示图书馆应增强法律意识,充分尊重著作权人的合法权利;将捐赠工作制度化;履行公益性文化机构的使命,为社会文化创造活动提供有利的条件.
