| 摘 要： | 临时复制问题既是我国信息法律体系建设中的重要问题,也是网络环境下图书馆提供数字信息时必须解决的著作权问题之一。国外对临时复制是否受著作权法中复制权制约的讨论大致有3种观点,即赞成说、否定说和折衷说。我国对临时复制问题进行法律完善,不宜完全照搬上述观点,应该对不同类型的临时复制区分为非利用性临时复制和利用性临时复制而采取不同的法律对策,作出不同的法律规定。由于浏览与缓存是用户获取数字信息时形成利用性临时复制的两种主要类型,因此,对数字浏览与缓存的合理使用问题进行了进一步探讨。
