| 摘 要： | 电子信息时代的法律证据不再局限于传统载体信息。随着近年来数字签名、时间戳以及区块链技术的不断成熟,推动电子数据成为法律凭证已成为必要之举。文章以互联网法院电子数据取证的实践为例,结合国内外已有相关研究成果,分别从法学界与档案学界的角度出发,阐释了电子数据在现有的立法、取证流程以及长期保存三个方面存在的不足,并提出档案部门应采取打通与司法部门的电子证据传输通道、在信息全生命周期中实施数据保全、规划公证数据流转与保存责任等策略,以保证电子凭证的真实有效。

| Abstract: | Legal evidence under the context of the electronic information age is no longer limited to traditional carrier information. In recent years, the mature technology of digital signatures, time stamps and block chain have made it necessary to promote electronic data as one of the legal evidence. Taking the practice of forensics process in the Internet courts as examples, the paper combines the relevant research results at home and abroad, and explains the shortage which in existing legislation, evidence collection process and long-term preservation of electronic data from the jurisprudence and archival science. The author proposed that the archives department should open up the electronic evidence transmission channel with the judicial department, implement data security on the whole life cycle of the information, and plan the notarization data circulation as well as data saving responsibility to ensure the authenticity and effectiveness of the electronic proof. |
