| 摘 要： | 学位论文是未发表的个人作品,学位论文的信息网络传播权受《著作权法》和《信息网络传播权保护条例》的保护,在学位论文作者没有把论文的信息网络传播权明确授予高校的情况下,无论其传播范围如何,高校图书馆自建学位论文数据库并通过网络提供服务的行为都不适用合理使用和图书馆例外的规定,是对作者信息网络传播权的侵权行为。
