| 摘 要： | 现代意义上的版权已经突破了严格地域性而取得了间接域外效力，但由于各国在版权立法上的差异以及国际版权条约与内国法保护程度的差异，涉外版权仲裁中法律冲突和法律适用问题仍然存在。我国处理涉外著作权争议只适用本国法，该规定与国际趋势不符，可以采取综合适用不同法律原则的方法，完善著作权法中的冲突规范。

| Abstract: | The effect of copyright has reached the outside territory of one country in modern eras.The legal conflicts and issues of applicable laws still exist due to the different legal provisions among the states and international conventions.For the Chinese law,which is to be used to dispose foreign copyright disputes, is contrary to the world trend,we can make revisions of copyright law by reference of compromised applicable rules. |
