| 摘 要： | 从法律和经济的角度分析DRM，讨论其存在的价值;指出DRM与合理使用、权利穷竭原则及隐私权保护之间的冲突;认为DRM中的利益失衡与DRM技术所采用的授权—许可模式、原始控制模式、非对称控制模式、非完整的控制模式有关;最后对基于DRM技术的数字出版业提出建议。

| Abstract: | Based on the value of DRM (Digital Rights Management) in law and economic, the paper analyzes the conflicts between DRM and fair use, right exhaustion, privacy. Then the paper indicates that the license pattern, the original control, the asymmetrical control and the partial control are the reasons of the conflicts. Finally, it gives some advices for the e-publishing based on DRM. |
