| 摘 要： | 开放科学数据是继自由软件运动、开放存取运动之后又一新兴的开放趋势,不能直接套用现有的许可机制。文章从科学数据来源、类型、权利与归属分析了科学数据的客体特征;从利益相关者和影响因素分析了开放科学数据的相关主体;以Panton原则为主线,分析了开放科学数据的利用机制。最后,结合国内开放科学数据现状提供了建议。

| Abstract: | Open data in science is a new trend after the free software movement and open access,which can not fit a variety of waivers and licenses which are designed for software or content.The object attributes have been analyzed from the sources,types,the rights and their belongings,as well as the subject study based on the stakeholders and influencing factors.Following the Panton Principles,the legal mechanics of open data in science have been studied.Finally,according to the development of open data in China,a few suggestions have been provided. |
