不当得利是债法的重要内容之一,其功能在于矫正无法律原因而导致的利益变动,其制度价值在于追求公平正义.目前我国正在制定民法典,为了构建完善、科学的不当得利制度规范,必须对不当得利制度有一个全面的认识.本文从我国实际出发,对不当得利制度的构成要件进行了分析,并在此基础上对我国不当得利制度的完善提出了立法建议和构想. 相似文献

德国不当得利法是清季变法和民国民法典不当得利法的理论基础,并在后民法通则时期于学术界受到重视,苏联不当得利法对我国不当得利法及其解释也具有潜移默化的影响。我国司法实践对不当得利法的态度则较为冷淡,与学理有着明显的疏离。我国不当得利法的解释,应当在对其渊源流变保持清醒认识和适当尊重的基础上进行审慎思考,在与现行立法框架和司法实践保持良性互动的基础上,构建自身的解释体系。 相似文献

法律精神是指制约并决定法律制度在社会中地位的价值和观念，它包括对法律性质的认识，对法律价值的评判，以及对法律在社会系统中地位的理解。它可分为国家法（公法）精神和民法（私法）精神。民法精神以个体为核心，个体以意思自治为原则，独立地创设平等主体之间的民事关系。民法精神包含：契约自由观念、权利义务观念、主体意识。社会主义市场经济下必须弘扬民法精神，完善民事立法，对中国传统及西方法律精神予以批判地扬弃、吸纳，使民法精神在今日中国勃兴起来。 相似文献

对于内容违法的民事行为，法律有必要确定以区别对待，即违反法律效力性规定的行为当然无效。而违反非效力性规定及法律有例外规定的行为则并不当然认定为无效。随着行为效力问题理论研究的深入，结合各国、各地区立法与司法实践经验，针对我国大陆立法与司法现状，有必要对我国大陆的民事行为效力理论进行价值和制度的双向重构：一方面在行为效力认定的价值构建中，重新确定立法的指导思想，将充分尊重民法之私法性、维护行为双方意思自治等理念灌输到法律中去；另一方面则从公法与私法关系、效力判断的理念基础等方面进行价值与制度的具体重构。 相似文献

自从1937年<返还请求权法重述>中将不当得利(unjuust enrichment)作为界定返还(restitution)的依据并首次提出返还请求权法以来,建立统一、独立的返还请求权法的可能性和必要性得到了英美法理论界的重视,并在1991年获得英国司法判例的承认.于是一个独立的、调整不当得利的请求权基础建立了起来,并与合同法、侵权法共同构成了英美债法中的三大支柱.从unjust enrichment的产生和渊源人手,通过对此制度与我国不当得利制度的比较分析,进一步对这个传统领域加以研究,可以从比较法的角度给我国的不当得利制度以较多的启发. 相似文献
