在分析数字环境对传统著作权的挑战及其引起的法律问题的基础上,指出了我国著作权立法的不完善之处,诸如缺乏数字环境下著作权的合理使用标准和公益图书馆的豁免制度。鉴于此,本文从立法者、司法者和守法者的视角,提出了国外原版图书数字化所面临法律问题的解决方案。立法者参照国际条约和发达国家的著作权法,完善我国数字环境下的著作权立法;司法者结合国内外的司法实践,对相关案件作出合理、公正的判决,为立法者提供立法依据;守法者依据现行法律、针对数字版权特征,依法、合理、善意地使用数字作品,如对读者资格进行注册限制、对数字作品采取加密措施等。
Abstract:
Based on the analysis of the challenges of the digital environment to the traditional copyright and the legal issues arising therefrom,this paper points out the imperfections of copyright legislation in China such as lack of standard for rational use of copyright and exemption system for public library in the digital environment.In view of this,this article proposes some solutions to the legal issues in the digitalization of foreign original books from the perspective of the legislators,the judiciary and the law-abiding personnel.The legislators perfect the copyright legislation in the digital environment in China by reference to the international treaties and the copyright laws of the developed countries.The judiciary integrates judicial practice in China and foreign countries to make rational and fair judgement on relevant cases to provide the legislative basis for the legislators.The law-abiding personnel use the digital works lawfully,legitimately and in a spirit of goodwill according to the current law and the characteristics of the digital copyright such as limiting the number of readers eligible for registration and adopting encryption measures for protecting digital works.  相似文献

The composition of fluid inclusions in the H2O-NaCl-CaCl2 system has been generally graphically estimated using the melting temperatures of hydrohalite ( Tm-HH ) and ice ( Tm-ice). Here we present two equations that can be used to calculate the relative proportion of NaCl ( i. e. , NaCL/[ NaCl + CaC12 ] , or XNacl ) and the total salinity ( i. e. , NaCl + CaCl2, wt% ) for fluid inclusions with ice as the last melting phase. XNacl can be calculated from Tm-HH using the following equation: y = (a+bx)^-1/c where y is XNacl, x is Tm_HH , a =0. 33124402, b =-0. 031518028, and c =0. 22932736. In the cases where only Tm-ice is measured and Tm-HH is not known, Tm-ice can be used as the maximum possible Tm-HH to calculate the maximum value of XNacl using the above equation. In these cases, the following equation can be used to calculate the maximum total salinity: y=(a+bx+cx2) l where y is salinity, x is Tm-HH , a =0, 057184817, b =0. 00078565757, and c = 5. 7262766E-6. Because the isothems in the field of ice are sub-parallel to the NaCl-CaCl2 binary side in the H2O-NaCl-CaCl2 ternary system, the errors in salinity calculation introduced by the above approximation are small ( less than 2 wt% ). A simple and reproduciable method for determining guanine by high performance capillary electrophoresis is presented. The method involved the use of 2-amino-5-mercapto-3,4-dithiazole as internal standard and 40mmol/L borax-H3PO4 (pH2)-5% EtOH as.the background electrolyte. The result showed that the linear range for guanine is 5-300 mg/L with the recovery of 94%-98% , the detection limit of 2. 80 mg/L and the RSD of 3. 1%. The satisfactory result was obtained when it was used to detect the concentration of guanine in acyclovir product.  相似文献

Content-based retrieval technology is widely used in multimedia databases.Some image databases use the color of image as the main retrieving content feature.Shape feature is also used to query image, such as moment variant,rotating angle, etc. In this article, a new approach is presented to retrieve image using the color and shape histogram in-formation. The color/shape-based retrieval technology has the advantages of accelerating the retrieving speed and resisting the image noise.  相似文献

The trademark having the nature of fraud refers to a word/device constituting a trademark that is confusing e-nough to mislead the average consumers as to the quality, raw material, function, use, weight, quantity, and place of o-rigin of a product. Article 10, paragraph one (7) of the Trademark Law prohibits those having the nature of exaggeration and fraud from being used as trademarks.  The “Quan Fang Bei Zu”, a first dictionary for Chinese plants, which contains 27 volumes in its first collection and 31 volumes in its second collection, was completed by Chen Jing-yi in 1253, the First Year of Bao You of Li Zong in Song Dynasty.  The first part of this encyclopaedia of plants is devoted to flowers.  The second part is of more varied nature, dealing with fruit trees, plants in general, herbs, trees, agriculture and sericulture, vegetables, and medicinal herbs.  These two collections cover 267 kinds of plants, each of which is described under two categories separately: The first category, “Si Shi Zu” in Chinese, meaning “facts of the plants” concerned, which again divided into 3 entries, i.e. the history, miscellaneous information and sundry bits of the plants. The second category, “Fu Yong Zu” in Chinese, meaning poetry, which divided into 10 meters, wherein the plants are described and eulogized in poetrical expressions.      Later on, the “Quan Fang Bei Zu” was used as a blueprint for some famous books in China, for example, the “Qun Fang Pu” and the “Guang Qun Fang Pu” all written and compiled after its model.  It is known today that in China there are only two extant hand writting copies of it, one in Beijing Library, the other in the Library of Yunnan University.  Both of them are listed as the best national books. Outside China, it is known that a third copy of is in the Congress Library in U.S.A.  As for the ori- ginal wood-carving copy printed during the period of the Song Dynasty, it is known so far that one copy is kept in the Library of Culture Ministry of Japan.  The Beijing Agriculture Publishing House has made a decision to photograph this carved copy in the Culture Ministry of Japan as one of the “Precious Series of China Agriculture Science”.  The book plays a very important role in the study of chinese botany, agri-culture science, medicine, history and literature.  相似文献

Objective:PCDD/Fs level in 22 fish samples was investigated in Pearl river Delta area in order that the PCDD/Fs pollution level in common fish can be evaluated. Methods: Dibenzo-p-Dioxins and Dibenzo-Furans was extracted from the sample by Soxhlet extraction, concentrated then purified by column chromatography, carbon column enrichment,. Confirmation and quantitative analysis at ppt(pg/g) level of PCDD/Fs was performed by HRGC/HRMS using multiple ion detection mode(MID). Certified reference material using Proficiency test sample fish muscle test material 0613 that was obtained from Central Science Laboratory(CSL) in Britain. Results: The average of concentration in wet weight is 1.261 ng/kg,, the average total WHO-TEQ for 22 samples is 0.246ng/kg wet weight. Generally, OCDD, 2,3,7,8-TCDF, 1,2,3,4,6,7,8-HpCDD was the main contributors to the total 17 PCDD/Fs detected, average account for 21%,16%,14%, respectively. While 1,2,3,7,8-PeCDD, 2,3,4,7,8-PeCDF, 2,3,7,8-TCDD were main contributors to the total WHO-TEQ, account for 40%,27%, 13% respectively. The total TEQ for 22 fishes ranged from 0.03 ng/kg wet weight to 0.878 ng/kg wet weight. Conclusions: PCDD/Fs level was largely different from sample to sample depending on the sample kinds. The level in the Pearl river Delta area fish samples is not distinct comparing with other countries, but some kind fish level should be paid more attention on it since its higher level. The relationship between source of PCDD/Fs and PCDD/Fs level in fish will be studied deeply in the future.  相似文献

Abstract:
Based on the mixed circulation management model of the new library and the old library where the documents can be borrowed and returned freely,and considering the reduction of cost and development complexity,this paper designs a Radio Frequency Identification (RFID) intelligent library management system,which is not only compatible with the old document management system,but can also exist and work together with it.The system makes full use of the central database of the original library document information management system,and by the use of the mediators,is integrated with the old library document information management system seamlessly,which not only embodies the technical advantages of the RFID intelligent library management system,but also realizes the management aim of borrowing and returning documents between the new and old libraries.  相似文献

 1)  The Compositae in Tibet so far known comprise 508 species and 88 genera, which nearly amounts to one fourth of the total number of genera and one third of the total number of species of Compositae in all China, if the number of 2290 species and 220 genera have respectively been counted in all China. In Tibet there are all tribes of Com- positae known in China, and surprisingly, the large tribes in Tibetan Compositae are also large ones in all China and the small tribes in Tibet are also small ones in all China. Generally speaking, the large genera in Tibet are also large ones in all China and the small genera in Tibet are likewise small ones in all China. In this sense it is reasonable to say that the Compositae flora of Tibet is an epitome of the Compositae flora of all China.      In the Compositae flora of Tibet, there are only 5 large genera each containing 30 species or more. They are Aster, Artemisia, Senecio, Saussurea and Cremanthodium. And 5 genera each containing 10—29 species. They are Erigeron, Anaphalis, Leontopodium, Ajania, Ligularia and Taraxacum. In addition, there are 77 small genera, namely 87% of the total of Compositae genera in Tibet, each comprising 1—9 species, such as Aja-niopsis, Cavea and Vernonia, etc.      2)  The constituents of Compositae flora in Tibet is very closely related to those of Sichuan-Yunnan provinces with 59 genera and 250 species in common. Such a situation is evidently brought about by the geographycal proximity in which the Hengtuang Shan Range links southeastern and eastern Tibet with northern and northwestern Sichuan- Ynnnan.  With India the Tibetan Compositae have 59 genera and 132 species in common, also showing close floristic relationships between the two regions. Apparently the floris- tic exchange of Compositae between Tibet and India is realized by way of the mountain range of the Himalayas.  The mountain range of the Himalayas, including the parallel ranges, plays a important role as a bridge hereby some members of the Compositae of western or northern Central Asia and of the northern Africa or of western Asia have migrated eastwards or southeastwards as far as the southern part of Fibet and northern part of India, or hereby some Compositae plants of eastern and southeastern Asia or Asia Media have migrated northwestwards as the northern part of Central Asia.      Some of the species and genera in common to both Tibet and Sinjiang indicate that this weak floristical relationship between these regions is principally realized through two migration routes: one migration route is by way of the Himalayas including the parallel ranges to Pamir Plataeu and Tien Shan, or vice versa. The other migration route is by way of northern Sinjiang to Mongolia, eastern Inner Mongolia, southwards to Gansu, Qinghai (or western Sichuan), eastern Tibet up to the Himalayas, or vice versa.      However, Tibet is not entirely situated at a migration crossroad of the floral ele- ments. An ample amount of the data shows that Compositae flora have a particular capability of development in Tibet. of the total number of species of Tibetan Com- positae, 102 species and 1 genus (Ajaniopsis Shih) are endemic. Besides, 8 genera are re- gional endemics with their range extending to its neighbourhood. The higher percentage of endemics at specific level than at generic in Tibetan Compositae may be a result of active speciation in response to the new enviromental conditions created by the uplifting of the Himalayas.  The flora in Tibetan Plateau as a whole appears to be of a younger age.       3) The uprising of the Himalayas and of the Tibetan Plateau accompanied by the ultraviolet ray radiation, the microthermal climate and the high wind pressure has, no doubt, played a profound influence upon the speciation of the native elements of Tibetan Compositae. The recent speciation is the main trend in the development of the Com-positae flora native in Tibet in the wake of upheaval of the plateau.  相似文献

Eritrichium mpestre (Pall.) Bunge is widely distributed in thenorthwest and northeast of China. As a Chinese folk medicine, it is extensively used to treat headache, angeitis, and anthrax. Especially, it is the preferred medicine prescribed for flu cure in Inner Mongolia of China. 1 An EtOH extract of the aerial part of E. mpestre was concentrated and partitioned with solvents further into petroleum ether-, CHC13-, EtOAc-, n-BuOH-, and H2O-soluble fractions. The EtOAc fraction was subjected to column chromatography with silica gel and finally purified by Sephadex LH-20 to yield compounds 1 (20 mg), 2(14 mg), and 3 (9 mg).  相似文献

The paper discusses the orientation of knowledge management in enterprises, a problem often neglected by the theoretical circles in the study of knowledge management. It points out that enterprise knowledge management is not exactly equal to knowledge management in theory, the former is only a branch of the latter. However, they are equally and alternatively used in practical applications as enterprise knowledge management is developing most rapidly and has the greatest influence. The Partner Group does research in cosmology, focussing on the quantitative modeling of the structure and evolution of galaxies and galaxy clusters, the pattern of galaxies and of larger structures. The usual approach in this field is the dark matter paradigm, i.e. the assumption that the basic structures are laid out in a matter component of particles which interact only gravitationally. Numerical simulations of large scale and high resolution are used to follow the evolution of condensations of dark matter particles during cosmological evolution.
