改革开放以来,我国的民间组织获得了飞速发展,但是也遇到了法律法规滞后、行政化色彩较浓、社会基础薄弱、发展不规范、工作机制不健全等五个方面的运行困境。由于目前政府对社会发展还有很大的影响作用,所以只有在政府的支持和引导下,走"人为建构"之路,才能推动我国民间组织的健康发展。  相似文献

本文研究了美国的两个代表性案件,通过表见代理理论的解释,Hdrolevel案和True Positon案明确技术标准制定组织应该承担反垄断法律责任,同时2004年《标准制定组织促进法》则规定技术标准制定组织的民事责任限于单倍损害赔偿。提出借助于行业协会对技术标准制定组织的涵括或是单独规定,中国反垄断法应明确规定以单倍损害赔偿为主的技术标准制定组织的民事责任。  相似文献

This study employs Cultural Identity Spectrum Theory to analyze identity construction and positioning of faith-based nonprofit organizations (FBOs). Intercultural communication studies have not adequately analyzed religion and identity, particularly as they intersect with socio-economic class and racial marginalization. Because religion is one of the most conflict-ridden social divides, the study situates FBOs as important (inter)cultural sites, and traces an FBO's Secular–Religious location on the Cultural Identity Spectrum to critically engage cultural discourses surrounding the organization, to shift its identity to serve historically marginalized groups. Building on the dialectical approach the study interrogates challenges of creating partnerships with diverse community stakeholders to promote enduring and far-reaching social change.  相似文献

目前农民专业合作组织发展数量多,但规模普遍偏小,对农民的带动能力不强。针对这种现状,本文运用集体行动理论进行分析。研究结果表明:从集体行动角度看,农民专业合作组织规模小的主要原因是小规模的农民专业合作组织能使集体内成员和主要发起人的收益增大,组织成本降低,组织内激励效果明显等。文章在此基础上进一步提出拓展专业合作经济组织规模的对策。  相似文献

Standards Development Organizations (SDO) make critical decisions shaping the direction of technological innovation. SDOs are usually considered to offer a neutral venue for the collaborative efforts of different stakeholders, which often pursue competing particular interests. Nevertheless, individuals acting on behalf of the SDO, such as working group chairs, are themselves often employees of individual SDO stakeholders. Recently, there have been concerns that over-representation of the employees of certain powerful stakeholders in SDO leadership positions may undermine the objectivity of SDO decision making. Nevertheless, to date, there exists no empirical evidence to corroborate these concerns. We find that being affiliated with one of the largest SDO stakeholders significantly increases an individual’s likelihood of being appointed to a leadership position at IETF, but not at 3GPP. At the same time, in both SDOs, working groups whose chairs are affiliated with leading stakeholders produce standards that are less cited and less referenced than standards produced by other working groups, in particular those chaired by university affiliates. Our findings suggest that the commercial interests of individuals’ employers may facilitate these individuals’ ascension to SDO leadership positions, but the potential for conflicts between these commercial interests of chairs’ employers and the organizational goals of the SDO may negatively impact the success of the working group’s standards.  相似文献

Artificial Intelligence (AI) is viewed as having great potential for the public sector to improve the management of internal activities and the delivery of public services. However, realizing its potential depends on the proper implementation of the technology, which is characterized by unique factors, that afford or constrain its use. What these factors are and how they affect AI implementation is still poorly understood, and scholars call for studies to add empirical evidence to the existing knowledge. This study relies on a case study methodology and, by adopting an abductive approach, applies a double theoretical perspective: the Technology-Organization-Environment (TOE) framework and the Technology Affordances and Constraints Theory (TACT). Drawing on these combined lenses, we develop a conceptual framework that extends previous studies by showing how AI implementation is the result of a combination of contextual factors that are deeply interrelated and, specifically, how AI-related factors bring new affordances and constraints to the application domain.  相似文献

This project provides an interpretation of how one cooperative support organization, the Nebraska Cooperative Council, discursively functions to help its constituent cooperatives consolidate resources in order to better intersect with organizations in a larger bureaucratic system. In analyzing qualitative data collected through in-depth interviews, surveys, and organizational documents, we found the paradox of stability and change a revealing prism through which to make sense of participants' experiences. We work toward locating and describing how the Council, through its boundary-spanning activities, helps cooperatives manage the paradox of stability and change while protecting their core participatory ideologies. By providing networks of learning, promoting the legitimacy of cooperative forms of organizing, and protecting cooperatives' interests, the Council is an entity helping cooperatives to reconcile their internal requirements for democracy with the external demands of the marketplace.  相似文献
