| 摘 要： | 本认为孔子的法治思想虽不够系统，但对于“德”与“刑”的关系提出了不少自己比较明确的观点。虽然他的法治思想带有相当的守旧性和局限性，但通过加强思想道德教育以减少刑罚、刑罚要适中等思想对于今天推进法治社会的建设仍有一定的借鉴意义。

| Abstract: | Though Confucius' Rule-of-law idea is not systematic enough,it explains a fairly clear position concerning the relationship between ethics and penalty .Though his rule-of-law idea is rather conservative and has its limitations,the ideas put forward,such as the reducing of penalty by way of strengthening moral education and the moderate exercise of penalty,still play an instructive role in pushing on today's constructing of a rule-of-law society. |
