| 摘 要： | 分析了当前民事行政抗诉案件中存在的问题：抗诉范围过宽，抗诉效果不确定，证据滞后，以及上诉制度功能的弱化等。在此基础上，本提出了改革和完善抗诉制度的建议：限制抗诉时证据收集的范围，完善现有的抗诉程序，在抗诉对象上应进行调整，抗诉时间的调整。

| Abstract: | It pays atteniton to the analysis of the problems existed in the case of civil administrative protest in hand. It faces such facts: It's too wide to the range of protest; It's not certain of the effects of protest. The proof is lagged and the function of appellant system is weak. Based on this, the paper introduces the suggestions in the revolution and perfection of the protest system, such as to restrict the range of collecting proof in litigating, to perfect the present procedure of protest and to adjust to the object and time of protest. |
