| 摘 要： | 司法控制是解决行政自由裁量权滥用的关键。目前我国司法控制出现的问题不是"合理性"审查的范围过窄,相反应将其严格控制在合法性审查的范围内。同时"滥用职权"是对行政自由裁量行为的实质性违法审查,我们应对实质性违法审查的标准进行完善。
