| 摘 要： | 宋代折杖法是宋代重要的刑罚改革措施,它的产生对宋代刑罚制度影响巨大,它的实施在一定程度改变了唐末五代以来酷刑肆虐、法出多门的混乱局面,但同时又导致宋代刑种配置不合理、刑罚轻重失衡。近年来,学界从多个角度对《折杖法》进行了探讨,并已有不少研究成果问世。但对于宋代折杖法的性质,法学界一直争论不休。本文主要对宋代折杖法的性质加以简要分析。
