| 摘 要： | 行政诉讼举证责任分配与民事诉讼相比具有其特殊性,行政程序举证责任的分配与行政诉讼举证责任的分配之间有着千丝万缕的联系同时存在着冲突。在分析上述问题的基础上,从证明对象上入手,将行政诉讼的证明对象分为"先前事实"和"行政行为合法性的事实",对行政诉讼举证责任的分配进行重构。

| Abstract: | Compared with that in civil litigation,the allotment of proof burden in administrative litigation has its own characteristics,and there are complicated relations as well as clashes between the two.Basing on the analysis of questions mentioned above,the thesis classifies the proof objects in administrative litigation as facts of pre-action and facts for administrative action legacy,and carries out a restructure of allotment of proof burden in administrative litigation. |
