| 摘 要： | 禁止限制性贸易行为理论是英美法系国家法院判断一项商业交易是否合法时,经常使用的司法理由之一.随着职业体育运动的商业化发展,该理论目前已经开始在职业体育领域内适用,如果某一体育行会对运动员的禁赛处罚措施超出法律许可的合理范围,则可能被法院以限制贸易为由,予以撤销.

| Abstract: | The doctrine of Restraint of Trade is the judicial bases for the court of the Common Law Countries to decide whether a business transaction is unfair. With the commercial development of professional sports,this doctrine has been applied in the area of professional sports.If the suspension given by the sports federations to the athletes goes beyond the reasonable limits required by the legislation,it will be dismissed by the court with the doctrine of Restraint of Trade. |
