| 摘 要： | 民主不仅仅是一种国家制度,其更是一种公共决策选择的程序,这种选择程序最终还体现为,民主是以其多数决的原则,来决定治理国家各个方面重大事项的最优原则.我们法律的制定、实施等诸多方面,就是凭借这种多数话语的权威来作出的.因此,民主是法的程序性基础.

| Abstract: | Democracy,is not only one kind of national system,but also one kind of procedure about the choice of commonality decision-making.This kind of procedure at last embodies that democracy is the majority-decision rule,which governed every important way in nation.Our legal system including the legislation and practice is decided by the majority-decision.Therefore,the democracy is the fundamental of the procedure. |
