| 摘 要： | 从分析体育权利的内涵和特征入手,对《全民健身条例》有碍于体育权利实现的问题进行分析,认为当前《全民健身条例》在实施过程中存在着法律责任主体的缺损、保障机关的缺位、全民健身保险制度不完善、农民全民健身的体育权利缺失等问题,进一步提出通过细化《全民健身条例》,增强可操作性;政企联动,建立相关的财政保障机制;完善体育保险制度;切实落实农民健身权利等几个方面的措施,确保体育权利在《全民健身条例》中的实现。

| Abstract: | From the perspective of the analysis of the connotation and characteristics of sports rights, this paper analyzes the problems of regulations on national fitness impeding the sports rights realization. It believes that the current national fitness reg- ulations have such problems as defect of legal responsibility subject, absence of guarantee agencies, the imperfection of national health insurance system, lack of farmers＇ sports rights, etc. It further puts forward refining the national fitness regulations and enhancing operability. It also proposes to establish related financial security mechanism and the linkage between government and enterprise, perfect the sports insurance system, earnestly implement the measures of farmers health right and so on, to ensure the implementation of sports rights in national fitness regulations. |
