| 摘 要： | 通过案例分析,对青少年体育运动中兴奋剂使用的现状进行分析;对青少年在体育团体内所受处罚法律依据的合法性加以探讨,为保护青少年的特殊权益对＂严格责任＂原则处罚主体进行必要的补充解释,指出在青少年反兴奋剂中应采取＂预防为主,教育为本＂的原则,提出＂立法＂在不同法律条文和在政府多部门联合执法的依据等方面存在明显缺失,导致执法＂不严＂,违法＂不究＂的状况,致使青少年反兴奋剂流于形式,无法操作。

| Abstract: | Through case studies,the author of this paper has analyzed present situation of doping in the young people sports,Legal basis＇s validity which punishes is discussed In sports association,and In order to protect young people＇s special rights and interests,Gives ＂the strict liability＂ the principle punishment main body to carry on certain expansion explanation.Pointed out that should adopt principle of ＂the prevention of Anti-doping is primarily,the education is the book＂ in the young people,Legislation in different provision of law and the enforcement of law lacks the legal basis that lead to law fail to carried on. |
