| 摘 要： | 教育惩戒长期处于在法律上没有明示，在社会习俗中予以默许的尴尬地位；惩戒是教育不可或缺的一部分，我们应该明确地赋予它合法的地位；教育惩戒法制化至少应该包括：法律定义、法规制定和程序控制这三个方面。

| Abstract: | Education punishment is a long - term ignored field in low and it is tacitly permitted by the social habits and customs. Punishment is an integral part in education and it is should be endowed with a legal position. Institutionalization at least consists of three constituents which are definition of law, formulation of law and regulations, and program control as well. |
