| 摘 要： | 法律原则是法理学给予明确解释的主题,基本原则作为体育法学科建设的基础理论问题,尚未达成共识。研究运用文献资料、规范分析等研究方法,以“法律原则”作为基础理论分析工具,对体育法基本原则进行评述,根据体育法基本原则的生成方式和价值取向,从法理学角度重构体育法基本原则,包括体育权利保障、体育竞赛公平、体育协调发展、体育组织自治、体育公益促进等5个方面,进而分析基本原则在《体育法》修订中的具体运用与实践。

| Abstract: | The principle of law is the subject of a clear interpretation of the jurisprudence, and the basic principle, as the basic theory of the construction of the discipline of sports law, has not yet reached a consensus. In this study, using the research methods of literature, normative analysis, the "legal principle" as the basis of the theoretical analysis tool, to review sports law basic principle, based on generation and value orientation of sports law principles, from the perspective of jurisprudence refactoring: basic principles, including sports, sports competition fairness, protection of the rights to coordinate development, sports organization and autonomy, promoting public welfare and so on five aspects, and further analysis of basic principles in the "sports law" modify practice use. |
