| 摘 要： | 从我国证据交换制度建构的现实需求出发,在对当事人主义证据交换模式和职权主义证据交换模式的理论和诉讼意义进行较为深入研究的基础上,比较分析了当事人主义证据交换模式和职权主义证据交换模式各自的优点和不足,对我国当前证据交换制度的现状及弊端进行剖析,并提出构建建议,以期对当前的司法改革有所裨益。

| Abstract: | Starting from the construction reality of our country evidence-exchange system,on the foundation of a more thorough research to the litigant principle evidence-exchange pattern and the authority principle evidence exchange pattern theory and the lawsuit significance,this paper conducts the comparative analysis of the respective merit and the insufficiency of litigant principle evidence exchange pattern and the authority principle evidence exchange pattern,carries on the analysis of the present situation of our country's evidence exchange system and the malpractice,and proposes some constructing suggestions which will have a benefit to the current judicial reform. |
