Post-mortem privacy is becoming a vital topic of public and scholarly legal concern. Post-mortem privacy is understood as the right of a person to preserve and control what becomes of his reputation and dignity after death. The assumption that the deceased does not qualify for privacy rights, because his bodily presence has been terminated, no longer holds in our networked society. In the digital age, the phenomenon of the digital legacy that an Internet user leaves behind after his demise, has led to new challenges for the legal system. The deceased is no longer in a position to exercise human autonomy as an active agent. The article reconsiders the notion of human autonomy with regard to these digital representations. Taking the point of view that the control over personal information (also known as informational self-determination) is essential in protecting one’s privacy in the antemortem life, the article explores whether this principle may have validity in the postmortem context. Legal philosophical arguments are advanced in a discourse about the quandary if digital personae of deceased persons can be bestowed with a legal basis of personality rights and concomitantly privacy rights. Therefore much attention is given to the problem of the subject, which does not seem to be functioning in the case of the absence of a living subject. Briefly referring to novel personae, it is argued that fundamental human rights need not be limited to the rights of living human beings.  相似文献

The ageing society poses significant challenges to Europe’s economy and society. In coming to grips with these issues, we must be aware of their ethical dimensions. Values are the heart of the European Union, as Article 1a of the Lisbon Treaty makes clear: “The Union is founded on the values of respect for human dignity…”. The notion of Europe as a community of values has various important implications, including the development of inclusion policies. A special case of exclusion concerns the gap between those people with effective access to digital and information technology and those without access to it, the “digital divide”, which in Europe is chiefly age-related. Policies to overcome the digital divide and, more generally speaking, e-inclusion policies addressing the ageing population raise some ethical problems. Among younger senior citizens, say those between 65 and 80 years old, the main issues are likely to be universal access to ICT and e-participation. Among the older senior citizens, say those more than 80 years old, the main issues are mental and physical deterioration and assistive technology. An approach geared towards the protection of human rights could match the different needs of senior citizens and provide concrete guidance to evaluate information technologies for them.  相似文献

The emergence of novel and powerful digital technologies, digital platforms and digital infrastructures has transformed innovation and entrepreneurship in significant ways. Beyond simply opening new opportunities for innovators and entrepreneurs, digital technologies have broader implications for value creation and value capture. Research aimed at understanding the digital transformation of the economy needs to incorporate multiple and cross-levels of analysis, embrace ideas and concepts from multiple fields/disciplines, and explicitly acknowledge the role of digital technologies in transforming organizations and social relationships. To help realize this research agenda, we identify three key themes related to digitization—openness, affordances, and generativity—and, outline broad research issues relating to each. We suggest that such themes that are innate to digital technologies could serve as a common conceptual platform that allows for connections between issues at different levels as well as the integration of ideas from different disciplines/areas. We then summarize the contributions of the 11 papers presented in this Special Issue relating them to one or more of these themes and outlining their implications for future research.  相似文献

This paper is as much about surveillance as about persuasive technologies (PTs). With regard to PTs it raises the question about the ethical limits of persuasion. It will be argued that even some forms of self-imposed persuasive soft surveillance technologies may be considered unethical. Therefore, the ethical evaluation of surveillance technologies should not be limited to privacy issues. While it will also be argued that PTs may become instrumental in pre-commitment strategies, it will also be demonstrated that the use of persuasive surveillance technologies in order to influence the users to become more compliant, to get their consent more easily or making it harder to opt out of the system does give rise to ethical issues.  相似文献

Transformative artificially intelligent tools, such as ChatGPT, designed to generate sophisticated text indistinguishable from that produced by a human, are applicable across a wide range of contexts. The technology presents opportunities as well as, often ethical and legal, challenges, and has the potential for both positive and negative impacts for organisations, society, and individuals. Offering multi-disciplinary insight into some of these, this article brings together 43 contributions from experts in fields such as computer science, marketing, information systems, education, policy, hospitality and tourism, management, publishing, and nursing. The contributors acknowledge ChatGPT’s capabilities to enhance productivity and suggest that it is likely to offer significant gains in the banking, hospitality and tourism, and information technology industries, and enhance business activities, such as management and marketing. Nevertheless, they also consider its limitations, disruptions to practices, threats to privacy and security, and consequences of biases, misuse, and misinformation. However, opinion is split on whether ChatGPT’s use should be restricted or legislated. Drawing on these contributions, the article identifies questions requiring further research across three thematic areas: knowledge, transparency, and ethics; digital transformation of organisations and societies; and teaching, learning, and scholarly research. The avenues for further research include: identifying skills, resources, and capabilities needed to handle generative AI; examining biases of generative AI attributable to training datasets and processes; exploring business and societal contexts best suited for generative AI implementation; determining optimal combinations of human and generative AI for various tasks; identifying ways to assess accuracy of text produced by generative AI; and uncovering the ethical and legal issues in using generative AI across different contexts.  相似文献

The accuracy principle is one of the key standards of informational privacy. It epitomises the obligation for those processing personal data to keep their records accurate and up-to-date, with the aim of protecting individuals from unfair decisions. Currently, however, different practices being put in place in order to enhance the protection of individuals appear to deliberately rely on the use of ‘inaccurate’ personal information. This article explores such practices and tries to assess their potential for privacy protection, giving particular attention to their legal implications and to related ethical issues. Ultimately, it suggests that the use of ‘inaccurate’ data can potentially play a useful role to preserve the informational autonomy of the individual, and that any understandings of privacy or personal data protection that would tend to unduly limit such potential should be critically questioned.  相似文献

The Internet of Things (IoT) is an emerging global infrastructure that employs wireless sensors to collect, store, and exchange data. Increasingly, applications for marketing and advertising have been articulated as a means to enhance the consumer shopping experience, in addition to improving efficiency. However, privacy advocates have challenged the mass aggregation of personally-identifiable information in databases and geotracking, the use of location-based services to identify one’s precise location over time. This paper employs the framework of contextual integrity related to privacy developed by Nissenbaum (Privacy in context: technology, policy, and the integrity of social life. Stanford University Press, Stanford, 2010) as a tool to understand citizen response to implementation IoT-related technology in the supermarket. The purpose of the study was to identify and understand specific changes in information practices brought about by the IoT that may be perceived as privacy violations. Citizens were interviewed, read a scenario of near-term IoT implementation, and were asked to reflect on changes in the key actors involved, information attributes, and principles of transmission. Areas where new practices may occur with the IoT were then highlighted as potential problems (privacy violations). Issues identified included the mining of medical data, invasive targeted advertising, and loss of autonomy through marketing profiles or personal affect monitoring. While there were numerous aspects deemed desirable by the participants, some developments appeared to tip the balance between consumer benefit and corporate gain. This surveillance power creates an imbalance between the consumer and the corporation that may also impact individual autonomy. The ethical dimensions of this problem are discussed.  相似文献

This paper analyzes ethical aspects of the new paradigm of Ambient Intelligence, which is a combination of Ubiquitous Computing and Intelligent User Interfaces (IUI’s). After an introduction to the approach, two key ethical dimensions will be analyzed: freedom and privacy. It is argued that Ambient Intelligence, though often designed to enhance freedom and control, has the potential to limit freedom and autonomy as well. Our lives are increasingly intertwined with the digital realm, and with new technology, new ethical problems emerge. The academic field that addresses these problems—which we tentatively call ‘digital ethics’—can be an important intellectual resource for policy making and regulation. This is why it is important to understand how the new ethical challenges of a digital society are being met by academic research. We have undertaken a scientometric analysis to arrive at a better understanding of the nature, scope and dynamics of the field of digital ethics. Our approach in this paper shows how the field of digital ethics is distributed over various academic disciplines. By first having experts select a collection of keywords central to digital ethics, we have generated a dataset of articles discussing these issues. This approach allows us to generate a scientometric visualisation of the field of digital ethics, without being constrained by any preconceived definitions of academic disciplines. We have first of all found that the number of publications pertaining to digital ethics is exponentially increasing. We furthermore established that whereas one may expect digital ethics to be a species of ethics, we in fact found that the various questions pertaining to digital ethics are predominantly being discussed in computer science, law and biomedical science. It is in these fields, more than in the independent field of ethics, that ethical discourse is being developed around concrete and often technical issues. Moreover, it appears that some important ethical values are very prominent in one field (e.g., autonomy in medical science), while being almost absent in others. We conclude that to get a thorough understanding of, and grip on, all the hard ethical questions of a digital society, ethicists, policy makers and legal scholars will need to familiarize themselves with the concrete and practical work that is being done across a range of different scientific fields to deal with these questions.  相似文献

Organizations struggle to comply with legal requirements as well as customers’ calls for better data protection. On the implementation level, incorporation of privacy protections in products and services depends on the commitment of the engineers who design them. We interviewed six senior engineers, who work for globally leading IT corporations and research institutions, to investigate their motivation and ability to comply with privacy regulations. Our findings point to a lack of perceived responsibility, control, autonomy, and frustrations with interactions with the legal world. While we increasingly call on engineers to go beyond functional requirements and be responsive to human values in our increasingly technological society, we may be facing the dilemma of asking engineers to live up to a challenge they are currently not ready to embrace.  相似文献

The Principles of Fair Information Practice are almost three decades old and need to be broadened to take account of new technologies for collecting personal information such as drug testing, video cameras, electronic location monitoring, and the Internet. I argue that the ethics of a surveillance activity must be judged according to the means, the context and conditions of data collection, and the uses/goals, and suggest 29 questions related to this. The more one can answer these questions in a way that affirms the underlying principle (or a condition supportive of it), the more ethical the use of a tactic is likely to be. Four conditions are identified that, when breached, are likely to violate an individual's reasonable expectation of privacy. Respect for the dignity of the person is a central factor and emphasis is put on the avoidance of harm, validity, trust, notice, and permission when crossing personal borders.  相似文献

Radio Frequency Identification (RFID) systems identify and track objects, animals and, in principle, people. The ability to gather information obtained by tracking consumer goods, government documents, monetary transactions and human beings raises a number of interesting and important privacy issues. Moreover, RFID systems pose an ensemble of other ethical challenges related to appropriate uses and users of such systems. This paper reviews a number of RFID applications with the intention of identifying the technology’s benefits and possible misuses. We offer an overview and discussion of the most important ethical issues concerning RFID, and describes and examine some methods of protecting privacy. Norman G. This paper provides an analysis of the current and potential ethical implications of RFID technology for the library and information professions. These issues are analysed as a series of ethical dilemmas, or hard-to-resolve competing ethical obligations, which the librarian has in relationship to information objects, library users and the wider social and political environment or state. A process model of the library is used as a framework for the discussion to illustrate the relationship between the different participants in the library system and it is argued that ethical analysis should involve the identification of future developments as well as current issues. The analysis shows that RFIDs do currently pose some dilemmas for librarians in terms of the conflicts between efficient service, privacy of users and an obligation to protect the safety of society as a whole, and that these are likely to become more problematic as the technology develops. 通用模型是近年来人工智能发展的重要方向之一。随着模型研发应用的增多,模型的社会和伦理影响受到广泛关注。文章从通用模型的特性出发、分析了模型在算法、数据和算力3个层面潜在的伦理挑战,包括不确定性、真实性、可靠性,偏见、毒性、公平、隐私及环境问题。进一步从技术哲学的视角分析了数据驱动的模型在人与世界关系中的中介性作用及所产生的“镜像”效应问题和透明性问题,提出了人与世界关系的新形态是以模型(数据)为中介的,即“人-模型(数据)-世界”关系。最后,从治理技术和治理机制两方面反思了当前的应对措施及局限性。建议建立开放式、全流程、价值嵌入的伦理规约机制,保障通用模型在合规、合伦理的框架下发展。  相似文献

数字经济背景下,人工智能(AI)技术的应用正在深入地影响着企业管理变革、业务边界的扩展和管理模式的改变。结合互补资产的观点和组织学习理论,本文提出了一个基于AI应用能力和AI管理能力的分析框架,强调人工智能与人类智慧结合的必要性,阐述了两种能力的功能和作用及其协同对企业效率和创新成本的影响。本文提出,企业必须具备管理AI的能力才能有效应对大数据、数字技术、AI的不断革新及技术带来的组织内部结构和外部环境变化以及风险;企业AI应用与管理能力的有效结合,有利于控制AI应用带来的成本和风险,增强企业在人工人力、协调沟通、和数据搜寻方面的效率,同时降低AI应用带来的数字基建、道德情感、数据安全、组织结构变革方面的成本,进而促进企业的组织学习、对内外部数字技术使能资源的获取和管理以及互补资产的形成,对企业创新绩效发挥正向作用。最后,本文为企业的数字化创新战略提供了新的发展思路。  相似文献
