The advent of electronic resources brought about the need for license agreements between libraries and publishers. Many librarians today are new to licensing and negotiating with publishers, or have received limited training and education. Based on her years of licensing and negotiation experience, Clair Dygert of the Florida Virtual Campus (FLVC) provided librarians with practical advice and tools for working with licenses and negotiating with publishers, as well as encouragement for entering into these new areas. She included examples taken directly from FLVC’s licensing guidelines and negotiation proposals and encouraged attendees to use those documents in creating their own local documents. She also drew on the book Getting to Yes: Negotiating Agreement Without Giving In by Roger Fisher and William Ury to describe principled bargaining as the most effective and constructive method of negotiation.  相似文献

For publishers and librarians to work well together it will help for publishers have a good idea of the circumstances and challenges currently facing libraries. This includes but is not limited to budget; libraries also struggle with a complex technology environment, quickly changing licensing, pricing and content options, and incomplete adoption of standards by publishers and software vendors. This paper is a short introduction to these issues and includes a brief overview of what publishers can do to help librarians, and what librarians can do to help publishers.  相似文献

The role electronic resources librarians (ERLs) have in licensing electronic content is the most relevant in the breadth of an ERLs core responsibilities. While ERLs are rarely lawyers in addition to being librarians, the role they play in educating stakeholders, negotiating with publishers and vendors, and crafting understanding of licensing terms is integral for the success of a rapidly growing and changing electronic collections environment. Often, new ERLs have to learn these skills on the job. Discussed are tools and resources for new ERLs to build their electronic content licensing competency and insight on how to educate to advocate for the ERLs role in licensing.  相似文献

The impact of evolving technology on those who create content and those who use it has raised many interesting copyright-related challenges that legislators, copyright experts, authors, publishers and licensing organizations around the world are looking to address. Several international initiatives underway highlight the evolving global copyright landscape, including a report commissioned by the UK government calling for the creation of a “Digital Copyright Exchange.” Through such international efforts—and through the content licensing experience of collective management organizations—the best solutions to the copyright challenges of our time can deliver efficiency to everyone involved.  相似文献

STM represents 250 publishing companies and learned societies, and recognizes that the advent of digital networks affects authors, publishers, librarians, and readers. Dialogue between publishers and librarians is essential to creating the sense of partnership and open-mindedness needed to meet the future needs of scholarship and research. Publishers and librarians have complementary roles and responsibilities, serving the same needs and facing similar challenges. The interests of publishers and librarians need to be rebalanced in order to seize the benefits of digital information flow. Legislation provides a framework of copyright, privacy, competition, and consumer law that protects against misuse while facilitating the flow of information from author to reader. If laws need to be amended, such changes should be made on the basis of the mutual agreement of all members of the community. There is much to be achieved without legislative change. Neither publishers nor librarians should shy away from the issues that divide them, especially the scope of fair use and the exchange of copyright information between libraries. A more detailed analysis of the impact of copyright exemptions is needed. The development of a predictable licensing environment and the testing of new business models requires co-operation between publishers and librarians, and leads to better mutual understanding. STM seeks dialogue with libraries and with other members of the research and scholarly communities in order to meet the challenges, opportunities, and expectations created by the digital environment.  相似文献

ABSTRACT

Scholars increasingly use text and data mining (TDM) methods to discover trends and relationships within complex digital data sets. In order to support this development in scholarly communication, librarians and publishers need to be knowledgeable about TDM methods, build partnerships with TDM researchers, and address challenges related to licensing and access to large document sets. The presenters of this NASIG session shared their experiences of supporting TDM as a library subject liaison, acquisitions librarian, and publisher representatives. Audience members discussed issues involving TDM of data from multiple publishers, local hosting of data sets and TDM activity by undergraduate students.  相似文献

Open publishing     
There is increasing pressure from academia to make the results of publicly funded research freely available to all. Preprint archives have grown up in some disciplines, and institutional archives are now being developed. While openly accessible preprints seem to have damaged publishers less than was originally feared, the final published versions of articles – when combined with sophisticated retrieval software – may turn out to be a different matter. Publishers have already done much to make their content more accessible through bundling, consortia licensing, access for less‐developed countries, more liberal customer and author agreements, and collective licensing. Some are experimenting with open access journals, although this may not work in all disciplines. It seems clear, however, that there are elements of value in journals themselves, and in the functions performed by journal publishers, which should survive.  相似文献

In this session of the NASIG and Society of Scholarly Publishing joint program, a panel of lawyers conversed on topics related to the creation of copyright policy that impact both librarians and publishers. The topics chosen were selected to highlight areas of possible controversy between librarians and publishers. Dialogue centered on the concepts of international first sale, fair use, licensing and mass digitization, library exceptions, possible revisions to sections of the U.S. Copyright Act, and the relationships between accessibility issues and copyright. Through conversational style discussions the panelists conveyed to the audience that achieving balance in copyright law is challenging and the process often creates constructive tension among the rights of stakeholders.  相似文献

Last year 1279 professional authors completed a lengthy questionnaire on their use of, and attitudes towards, technological tools for writing and publishing. The data were analysed quantitatively, by examining the most frequent responses to items on the questionnaire, and qualitatively, by looking closely at details illuminating the relationship between authors and publishers. The results, for present purposes, are divided into three broad bands of interest: first, what types of writing software authors are currently using; second, what the implications of using authors’ disks in the publication chain are; and third, how technology alters perceptions of the ‘copy’ as a unit of sale. Findings suggest that though authors are operating at basic levels, they have embraced technology with more enthusiasm than their publishers. The challenge facing those involved in books is to make provision for presenting and displaying work in electronic form: to improve contracts and licensing agreements, and to disseminate information on technology to authors.  相似文献

Lebanon’s publishing industry is mainly turned towards export to the Arab market; subsequently, the analysis of the Lebanese book production can provide a fair overview of the state of publishing in the Arab world. And the picture is far from bright; however resourceful and dynamic, Arab trade publishers cannot reach the sales figures one would expect in a region of more than 362 million people. A relatively low purchasing power and the lack of efficient distribution channels, in addition to piracy and censorship, are endemic problems they have to face on a daily basis, not only in marketing their books throughout the region, but also in dealing with foreign publishers and agents. Indeed for many of these, the Arab market remains incomprehensible and not transparent. However, it is only through apprehending its reality that they can adapt their level of expectations to it in order to achieve successful licensing deals and establish sound partnerships in the region.  相似文献

This article examines how consortia can engage commercial publishers' hybrid open access (OA) publication programs. The article argues that it is appropriate and necessary for consortia to demonstrate leadership in influencing the information marketplace. Two models for negotiations are examined: 1) “market determinative” strategy, and 2) “consortium discount” strategy, comprised of three variations on existing consortia practices. An examination of the advantages and challenges indicates that the latter would have a greater chance for success. Keys to this conclusion include: establishing linkages between consortium licensing and hybrid titles, cost containment/alignment, and engaging publishers through an integrated model approach.  相似文献

Summary

The level of activity among libraries and publishers in Scandinavia with regard to electronic journals is relatively low. However, the interest in and discussions of this subject are widespread and it is on almost everybody's agenda. Some electronic journals are considered, including the Nordic Journal of Philosophical Logicand several pilot projects are also presented and discussed.

There are considerably more initiatives in the international arena, and one important conclusion is that the development of electronic versions of scientific journals makes the world “smaller,” that is, it is less difficult for the regional publisher to reach the international community of scientists. Many of the challenges that publishers face in the world of e-journals are considered, including copyright, fair use, one-stop-shopping, access control, printing, pricing and licensing.

The traditional system of scholarly communication has emerged over a period of hundreds of years and is now well-established regionally as well as internationally. This article attempts to identify whether there are specific characteristics with regard to new ways of disseminating scientific results in the Scandinavian region, and looks into practical experiences from the development of electronic journals.  相似文献

著作权管理是高等学校机构知识库资源建设的重要法律问题。以著作权状态为标准,可以把高校机构知识库储存的资源分成五大类。高校机构知识库资源征集的著作权障碍包括:著作权政策不完善、共同拥有的著作权的制约、作者对著作权侵权的担忧、著作权立法存在不确定性。解决该问题应采取如下措施:制定统一的机构知识库著作权管理的政策架构、提高机构知识库著作权资源授权协议的规范性、建立鼓励性与强制性相结合的资源自存储政策、主动与出版商合作建立著作权的许可使用机制、在高等教育界宣传普及机构知识库的基本知识。  相似文献

The changes in journal internationality in mainstream science were examined using 1,398 journals and 2,557,229 papers during 1991–2014. The authors’ country of affiliation in journals’ papers and references of multinational and national publishers were analysed. The results showed that journals’ papers and references have become more globalized over time. On average, older journals are more international than the newer ones. Although multinational publishers publish more international journals than the national ones do, journals from national publishers have internationalized faster than those from multinationals. The difference between these two groups of publishers is much greater in authoring compared to referencing. For both groups of publishers, the most changes in journal internationality occurred between the fourth and sixth year of indexing in Web of Science. Journals and papers in Humanities journals have the highest rate of increase of internationality although Natural Sciences and Engineering and Technology have the most international papers. Agricultural Sciences has the least international papers; however, these papers cite a wider range of countries’ papers compared to other fields. Journals in Medical and Health Sciences, Natural Sciences, and Agricultural Sciences have the most international references.  相似文献

Fred Kobrak, who has spent much of his career marketing U.S. scholarly books abroad, puts his experience to use in viewing the task of foreign publishers who wish to sell their products in the U.S. market. In so doing, he discusses changes in the environment of scientific publishing and raises the interesting question of how one distinguishes between “domestic” and “foreign” publishers. He suggests that “U.S.” publishers have much to learn from “foreign” competitors, and that competition can benefit publishers, their authors, and their customers. Fred Kobrak is a partner in Adrian Higham Associates, consultants, on the international publishing industry. The economic downturn and continuing budget concerns have libraries, publishers, and vendors making strategic changes as they seek to provide a high-level of services at a time when uncertainty continues to dominate planning and development. Creative thinking has become the norm as organizations seek to challenge long-held views and uncover and implement needed changes. Librarians, publishers, and vendors have all experienced a period of assessment, strategic review, and reaction as a result of the continued evolution from a print-based model to one dominated by electronic dissemination of scholarly information and the new role eBooks promise to play. This article addresses some of the important actions taken by librarians, publishers and vendors to cope with changes forced by both the economy and budget pressures, by the continued migration of scholarly resources to electronic formats, and by current and planned eBook activities and new eBooks models. It explores patterns in library content selection and spending trends, publisher prices and pricing models, as well as vendor strategies and challenges.  相似文献
