Copyright law is one of the many policy forces shaping the utilization of information resources. American copyright law has undergone many changes with profound consequences, particularly for educational and scholarly uses of existing copyrighted works. This article summarizes recent developments in the law, with a focus on their consequences for users at American colleges, universities, and libraries. The purpose of this study is to highlight the principal implications of an evolving copyright law and especially to assist librarians, administrators, and other policy makers. They must address these issues and devise standards of practice that avoid legal challenges but that also optimize the use of available resources. The article concludes with guidance for future concerns and planning.  相似文献

Because of fair use, individuals making single-copy photocopies of copyrighted material are seldom directly concerned with copyright. Librarians, the chief suppliers of copies, are given many exemptions in the Copyright Statute, but under a multi plicity of conditions. The Statute is not a model of clarity, especially for industrial libraries. In the future, both librarians and publishers have more to gain from cooperation than from confrontation, and their stress should be on ethics and empathy. This paper attempts to clarify some of the copyright aspects still in question, especially since technological developments will introduce further complications.  相似文献

Abstract

Librarians with an interest in electronic reserves were, for the most part, disappointed by The Technology, Education and Copyright Harmonization Act (TEACH Act). The Act provided classroom instructors with relatively clear guidelines as how they could use copyrighted materials online classes without violating the law. Mention of libraries, however, was conspicuously absent and the Act offered no direct guidance for what sort of library materials could be placed on the Internet. The guidance it offers though is more indirect. It gives some sense of how the legislative branch views the rights and responsibilities of educators in the use of online materials. It will offer guidance to the judiciary when, inevitably, a copyright dispute involving electronic reserves ever goes to court. It is important that librarians understand the TEACH Act and what it meansto education.  相似文献

Library projects to develop online instructional media can strain budgets and resources for technical expertise. New Flash-authoring tools may provide an inexpensive, easy-to-use, and quick alternative for librarians. The University Library at Cleveland State used a Flash-authoring tool to create a series of Web-based learning modules to deliver library instruction to undergraduate students. 我国《著作权法》第三次修订工作于2011年7月启动,2012年3月国家版权局发布《著作权法》修改草案第一稿,面向社会征求意见.全国图书馆界积极行动,结合实际,认真研讨,发现其中的不足有:舍弃了多个公益非营利网络传播适用的权利限制条款;信息网络传播权限制条款仍由国务院法规制定,没有由《著作权法》统一整合;没有采纳图书馆界提出的为非营利公益图书馆利用网络收集、保存、传播受著作权保护作品设置豁免条款的建议.图书馆界提出了一系列改进建议,并以书面形式上报文化部和国家版权局.2012年7月,修改草案第二稿公布,部分回应了图书馆界提出的设置合理使用兜底条款的建议,但未从根本上解决权利保护与权利限制失衡的问题,而且搁置了当代《著作权法》修订无法回避的信息网络传播权保护与限制条款的系统整合问题.图书馆界希望《著作权法》的修订落实独立性、平衡性和国际性三项基本原则,以保障著作权人利益与公众利益的平衡.参考文献4.  相似文献

SUMMARY

Reference librarians at St. Charles Community College discovered the benefits of cooperation when they began the process of creating an online library tutorial. In the fall of 1999, librarians realized that their walk-in library sessions were becoming ineffective due to poor attendance by students. The tours didn't fit into on-campus students' busy schedules, and failed to serve distance students at all. Two reference librarians decided to work together to create a web-based tutorial introducing students to library online resources. It was an informal process that started with information gathering on what tutorials exist, how they were developed and what type of software was used. After the librarians decided on the format and appropriate software, they brought together their creative and technical strengths to design an appealing and functional tutorial. To create a “virtual tour” of the library's physical layout, the librarians also collaborated with the Instructional Support Center, a group of educational technology specialists who are part of SCC's community college consortium. The tutorial was completed in only a year, partly because working in a small library allows for constant contact between the librarians, but also due to the efficiency of using cooperation. This successful collaborative project eventually won the Missouri Community College Association's 2001 Technology Innovation Award.  相似文献

Although many Internet users presume linking to online content is permissible, copyright owners have long complained that it constitutes copyright infringement. The Supreme Court recently resolved this issue in ABC v. Aereo, holding that pursuant to the Copyright Act’s “Transmit Clause,” an Internet transmission of a copyrighted work is a performance of it. Therefore, inasmuch as transmission occurs by inserting and clicking on a link, the link performs the copyrighted work, and may infringe. This article analyzes linking as a species of copyright infringement, and details which types of links infringe, who faces liability, and what defenses exist.  相似文献

During the spring 2007 semester, a large cohort of undergraduates enrolled in the BUS110 course offered through the Stony Brook University College of Business. The business librarian and other library instruction librarians provided single library sessions to all sections of the course. Toward the end of the 1-hour library information session, the students were asked to fill out an online user satisfaction survey to assess how much they had learned and to evaluate the teaching tools and methodology of the librarians. Toward the end of the semester the business librarian posted a follow up survey to the BUS110 Blackboard site to assess whether the students had used the resources demonstrated by the librarians in the library session, whether they had had follow-up interactions with the librarians, and whether they had positive attitudes toward the library, librarians, and business databases. The majority of students had used the databases and had a positive attitude toward the instruction and the library.  相似文献

Professional development for instruction librarians is in danger of coming to a standstill in difficult economic times. COIL on Wheels is a professional development roadshow developed by the Community of Oklahoma Instruction Librarians to allow librarians with budget and staffing issues to benefit from peer training. By matching member librarian interests with institutional needs, librarians can visit institutions in their geographic area to provide their colleagues with low-cost or free training. This article discusses the origins of and rationale for this program and describes a successful implementation of this traveling professional development project.  相似文献

SUMMARY

This paper will briefly review the canon debate in African literature, situating it within a wider context of debates on other non-Western, non-central or emerging disciplines. It will then examine ways in which reference services can respond to the challenge of canon expansion, and how librarians can impact the study of African women writers in universities and colleges. I will approach these topics from two perspectives. The first involves reference librarians in their traditional role as information mediators. Using the works of female writers as examples in instruction sessions and reference guides are ways in which traditional methods can be given a new twist. In so doing, reference librarians will be combining intercultural literacy with information literacy. A bibliography of selected works will also be given that will help general reference librarians strengthen their collections and educate themselves on the subject.

The second will be on ways in which librarians can add a layer to traditional mediating by becoming academic activists. In other words, instead of passively waiting for courses to be created and then supporting them, librarians can market to faculty ideas for possible uses of the Africana collection and thus provide impetus for new course development. Suggested initiatives include developing theme-related guides or readers' advisory based on African women's texts, and distributing them to other Area Studies faculty–an obvious way to encourage comparative, interdisciplinary research and teaching. Librarians can also hold workshops to demonstrate how works such as Aidoo's Changes or Dangaremgba's Nervous Conditions that examine the many faces of modern Africa can be discussed in social history, politics or education courses; or Alifa Rifaat's works dealing with women in Islamic communities in a religion or comparative law course. Additionally, libraries need to go beyond in-house, library-only lectures to organizing, for example, campus-wide author lecture series.

To effectively implement these initiatives, reference librarians should collaborate more closely with Africana and Area Studies bibliographers. As librarians in the 21st century, we should be more proactive in our academic communities. We can generate impetus for breaking the literary canon and broadening literary research, foster greater understanding of African culture, while still playing our time-honored roles of guide, mediator, culture-keeper, and agents of change.  相似文献

Some librarians embrace discovery tools while others refuse to use them. This lack of consensus can have consequences for student learning when there is inconsistent use, especially in large-scale instruction programs. The authors surveyed academic librarians whose institutions have a discovery tool and who teach information literacy classes in order to identify barriers to using them and to develop strategies to effectively integrate them into instruction. The authors used the survey results and recent studies on the research habits of undergraduates to propose strategies for integrating the discovery tool at the programmatic level in a more meaningful and sustainable way.  相似文献

Georgia State University Library's Education and Communication liaisons teamed up to teach a graduate course on the selection and use of reference resources for the College of Education's Library Media Technology Program. The collaboration between these two librarians can serve as a model for collaboration on three levels: collaboration between two librarians as co-teachers; collaboration between university librarians and academic department faculty; and, finally, “collaboration across work places” between academic librarians and school media specialists in P-12 settings. This paper outlines the case studies of two librarians who work closely with graduate students in fine arts programs. Realizing that graduate students can often experience a unique form of research anxiety, both librarians collaborated with faculty to embed themselves into the research methods courses of their programs. Both librarians found that the chance to work one-on-one with graduate students resulted in a reduction of their anxiety, an increase in information literacy skills, and a strengthened partnership between the librarians and the departments.  相似文献

In this article, three librarians from Santa Fe College, the community college winner of the 2015 ACRL Excellence in Academic Libraries Award, share their successful work in information literacy instruction. While the ACRL award is given for overall achievement, this article focuses upon their creative and varied approaches to instruction, incorporating a wide blend of strategies to reach students across the college. Beginning with targeted approaches to virtual instruction, including broad use of the flipped classroom model, and building in active learning techniques, the librarians at Santa Fe College have built an instruction program that could serve as a model to community college libraries across the country.  相似文献
