| 摘 要： | 主要运用文献研究法,对体育知识产权保护的现状进行描述分析,进一步对体育知识产权保护及其研究中存在的问题进行辨正论析:关于体育标志权和电视转播权的保护已达成共识,但缺乏普适性研究与法律保护;关于运动竞赛表演知识产权、民族传统体育、体育非专利技术等知识产权的研究和保护力度不够,且还存在研究理念上的问题;体育知识产权保护应立足于体育的特殊性进行专门性研究.

| Abstract: | With the method of documentary data,the current situation of the protection of sports intellectual property rights is analyzed and the following problems about sports intellectual property rights as well as its research are further analyzed.Many conclusions have been done in the research of sports marks right and sports TV relay right,but there is a lack of its basic study and legal protection.The sports game and physical intellectual property right,national physical intellectual property right and sports non-patent information right haven't been completely studied,and there are a lot of idea problems.The research on the protection of sports intellectual property right ought to be based on the particularity of sports. |
