律师-当事人保密特权和律师工作成果保护是英美法系证据特权规则中最具有学术研究意义和价值的核心内容。这两项特权制度的存在不仅可以更好地保护当事人的权利,而且对于健全律师制度、促进律师在法律事务中发挥更大的作用具有重要的意义。本文以证明责任的承担为视角,对美国证据法中的律师-当事人保密特权和律师工作成果保护这两项特权制度进行了细致的研究,从而归纳出二者的共同因素,并结合中国的立法现状,分析了我国民事证据法中律师-当事人保密特权和律师工作成果保护制度设立的必要性和可行性,从立法方式、特权规则范围、特权规则的负面效应、审前程序以及一系列的相关规则等方面对在我国构建这两项特权规则提出了具体的建议。 相似文献

认罪认罚从宽制度与值班律师制度有着紧密的联系,值班律师制度的好坏直接影响着认罪认罚从宽制度的有效运行。当前的值班律师制度在运行过程中,体现出不具备辩护人权利、介入时间不确定、法律服务质量差、衔接机制不畅等缺点。这些缺点的存在使得认罪认罚从宽程序的设立初衷难以实现,造成程序难以启动、被追诉人虚假认罪、浪费司法资源的问题。通过分阶段赋予值班律师相应权利、明确介入时间、加强管理与与保障以及完善衔接可优化值班律师制度。 相似文献

随着刑事诉讼制度的发展,加强侦查程序中的人权保障,提高犯罪嫌疑人在侦查程序中的诉讼地位已成为一种世界性的趋势;而犯罪嫌疑人的人权保障突出表现在辩护律师介入侦查程序行使辩护权方面。我国刑事诉讼法对侦查阶段律师权利的规定有许多不足之处。笔者提出具体完善建议:确认律师在侦查阶段的辩护人地位;完善犯罪嫌疑人获得辩护人帮助权的保障措施;赋予律师独立的会见权;赋予律师以调查取证权与请求证据保全的权利;赋予律师以讯问到场权。 相似文献

在中国目前的现实情况下,随着律师队伍的壮大和相关法律的不断完善,构建律师在场权制度是有其可行性的,它能促使侦查机关及其人员提高侦查技术,增强其综合办案能力,从而提高讯问的质量;能减少翻供的机率,提高诉讼效率。而在具体的设置上,我们可以从"刑法中的规定"、"在场权的具体含义"、"在场权的实现程序"、"律师不在场或不正确履行职责的法律后果及救济途径"、"律师在场权的例外情形"来加以考虑,使其具有可操作性。 相似文献
