刑法从其诞生之日起就以严酷性著称,刑法作为一种必要而又不得已的恶,适用得当可以维护社会秩序、有效保障公民权利,若滥用则会危害社会,给国家、社会和个人造成不可挽回的损害。一个国家的法律体系,尤其是刑法体系的优劣,必须建立在对人性、人道和人权充分研究的基础之上。在刑事立法、司法及构建现代刑事司法制度的进程中,如何彰显人性、坚守人道,并最终实现保障人权是我们当代学子必须予以认真对待的问题。 相似文献

限制加重原则是我国刑法所规定的基本原则。这一原则在我国刑法第69条表述为：“判决宣告以前一人犯数罪的，除判处死刑和无期徒刑以外，应当在总和刑期以下、数刑中最高刑期以上，酌情决定执行的刑期。”同时该条还规定了应执行的刑期最高不能超过的限度。这一表述结合刑法第99条“以上、以下、以内，包括本数”的立法解释，如执行“以下”和“以上”，分别违背了并科原则和吸收原则各自的适用范围，同时也与限制加重原则的立法本意相悖。建议，应将刑法第69条中的“应当在综合刑期以下、数刑中最高刑期以上”修改为“应当在低于总和刑期、高于数刑期中的最高期之间。” 相似文献

沈家本<历代刑法考>提出"宋无罚金之刑"的论断不妥.宋代有罚金之刑,且适用于司法、教育、人才选拔等方面,所罚数量从6斤、8斤、10斤到100斤不等,适用罪名有失职渎职罪、擅权罪及欺诈罪等.而普遍存在于宋代的"罚铜"其实是广义层面的罚金刑,其处罚等级约有1斤、2斤、120斤等18个等级,适用范围也很广. 相似文献

罚金是我国新刑法规定的一种刑罚方式,但修订后的刑法在罚金刑的数额、执行等方面规定得过于原则,带来了审判实践中操作困难、罚金数额混乱、空判严重等问题。如何使罚金刑得到切实地执行,需要我们进一步改进制度：一是明确执行主体,加强法院内部审执机关的联系,建立严格明晰的档案制度,规范执行程序。二是完善罚金刑分期执行制度,建立罚金刑执行与减刑假释相挂钩的方法。三是实行执行保障和救济措施,建立异地委托执行制度。 相似文献

《刑法修正案(八)》将"恶意欠薪罪"吸纳。反观该次刑法修正案审议的全过程,"恶意欠薪"这一行为是否应犯罪化一直颇有争议,虽然现在已然尘埃落定,但其中的争议点仍旧值得我们去思考:一种行为具有社会危害性是否必须入刑?如何判断罪与非罪的分界点?通过对刑法谦抑的研究,笔者认为,社会危害性并非是犯罪化的充要条件,刑法谦抑性是把握罪与非罪的"度",因而"恶意欠薪"犯罪化应有条件。本文中,笔者从罪之谦抑和刑之谦抑的角度,结合自己理解的谦抑理念,对"恶意欠薪"犯罪化的条件做出了简要分析,并简单评价了《修正案(八)》的合理与不妥之处。 相似文献

面对如今官场权色交易愈演愈烈的现状,性受贿是否入刑已经成为社会讨论焦点。在限定性受贿的表现形式的前提下,从性受贿应否入罪、如何入罪这两个维度出发进行探讨。性受贿入罪具有普遍的民意基础和法理依据,也与我国历史和国际反腐趋势一致。就性受贿如何入罪而言,当前的权宜之计是运用刑法解释学,对性受贿中的"受托人利用职务便利获得请托人用金钱雇佣的性服务"纳入"财产性利益"的范畴,以便适用现行刑法关于受贿罪的相关规定。长远观之,从立法层面将受贿罪的"财物"扩大为"利益",才是改良受贿罪的根本之道。 相似文献

在实践中,我国刑罚合理的理想并没有得到真正实现,主要体现为死刑与生刑的严厉程度差距巨大,可谓是生死两重天,需要通过修改刑法适当调整。此次刑法修正案八对刑罚结构内部各刑种之间力度的衔接方面进行了优化,使我国的生刑结构趋于合理,机能发挥更为充分,具有重大的理论和现实意义,但是我国的刑罚生刑结构还有进一步完善的巨大空间,需要进一步优化有期徒刑的内部结构,完善死缓、无期徒刑犯减刑的规定,增加若干资格刑,提升罚金刑的地位以实现我国刑罚结构的轻刑化,体现我国刑法的谦抑精神和以人为本的价值取向。 相似文献

醉驾虽已入刑,但关于其是否一律入刑的争论却仍未停止。从刑法第13条但书的规定来看,醉驾入刑应符合《刑法》总则第13条规定,即情节显著轻微危害不大的,不认定为犯罪。作为一种抽象危险犯,关于醉驾危险状态的判断必须坚持在行为实施的时间、地点、环境等客观基础上,从一般人的立场判断危险状态是否存在。此外,从犯罪主客观要件相统一原则和罪责刑相适应原则来看,醉驾亦不应一律如刑。 相似文献
